Teacher Shot by 6-Year-Old: Lawsuit Filed & Legal Consequences

Must read

Shocking bodycam footage captured the aftermath of a teacher being shot by a young student. Abby Zwerner sustained injuries to her hand, chest, and lung when the six-year-old student opened fire while they were in class at Richneck Elementary School in Virginia. Despite undergoing multiple surgeries and a lengthy hospital stay, Zwerner still has a bullet lodged in her chest, has lost the use of her left hand, and has been diagnosed with post-traumatic stress disorder.

Zwerner filed a lawsuit against the former assistant principal, Ebony Parker, alleging negligence for not taking action despite prior warnings that the student might have been armed. The incident occurred on the day the student returned to school after being suspended for damaging the teacher’s phone.

During the court proceedings, Zwerner’s attorney sought damages for the lasting physical and emotional trauma inflicted by the shooting. The defense argued that it was unforeseeable for a first-grade student to bring a firearm to school, emphasizing that the assistant principal could not have predicted such an event. Ultimately, the judge dismissed claims against the school’s principal and district superintendent.

Meanwhile, the student’s mother, Deja Taylor, faced legal consequences for child neglect and weapons charges. Her son, who moved to a different school under his great-grandfather’s care, admitted to accessing her handgun from her purse without proper safety measures in place. Taylor’s claims of securing the firearm with a trigger lock were refuted by investigators.
