Granddaughter sentenced for £125,000 theft from vulnerable grandfather

A granddaughter, Madeline Shaw, took £125,000 from her vulnerable grandfather, leaving him without essential items like toiletries. Shaw accessed John Mallaby’s bank account after he was moved to a care facility due to injuries from a fall in January 2019. Despite his daughter’s wish for him to relocate to Scotland for closer care, Shaw opposed the idea.

In August of the same year, Shaw was granted lasting power of attorney over Mallaby’s finances, having informally managed his money before. Authorities intervened in January 2020 due to concerns over Shaw’s actions with Mallaby’s account. Despite an official warning in November 2020, Shaw continued withdrawing funds, totaling £125,000, even after Mallaby’s passing in September 2021.

Shaw, residing near Thirsk, was emotional as she received an 18-month prison sentence for fraud by abuse of position. The court determined she had gained £71,601.05 from the scheme and scheduled an assets confiscation hearing for the upcoming spring. The judge highlighted Shaw’s negligence in meeting Mallaby’s basic needs and care home fees while draining his account.

Investigating officer PC Emma Harris condemned Shaw’s betrayal of trust, emphasizing that she misused Mallaby’s funds for her gain. Shaw’s fraudulent activities came to light after Mallaby’s daughter, as his executor, discovered unpaid care fees despite Mallaby’s substantial savings. Alam-Cheetham stated that Shaw’s actions stemmed from naivety rather than premeditation, as she invested part of the stolen money in a fraudulent property scheme.

Shaw, who lacked understanding of her responsibilities, expressed remorse for her actions, insisting she thought she was acting in Mallaby’s best interest. She had previously worked as a hairdresser and administrator and claimed the misappropriated funds were used for family expenses. Shaw’s family members feared repercussions if she were incarcerated.
