The Yukon Court of Appeal has rejected an appeal by Rudra Amin, a man convicted of sexual assault. Amin, currently residing in Calgary, was found guilty in 2023 of assaulting three women in Whitehorse between 2017 and 2018. The victims reported the incidents in 2020, leading to Amin’s conviction on four counts of sexual assault following a jury trial.
Following his sentencing, Amin promptly filed an appeal and was subsequently released on bail. In his appeal, Amin sought a reduction of his slightly over two-year sentence by two months to potentially qualify for a conditional sentence order, citing concerns about immigration repercussions.
However, Justice Susan Griffin, in her ruling released on Aug. 6, dismissed Amin’s appeal. Griffin refuted Amin’s argument that the original sentencing judge had erred and rejected the appropriateness of granting a conditional sentence in Amin’s case. Griffin emphasized that Amin’s plea to shorten his sentence lacked proper grounds unless there was a fundamental error impacting the sentencing process.
“This is merely minor adjustment and falls outside the scope of this court’s jurisdiction,” stated Griffin in her decision. Consequently, Amin will serve the entirety of his just over two-year sentence.
