Cartel Bushnell and Leo Knight, who were previously imprisoned for the accidental killing of 16-year-old Mikey Roynon during a birthday celebration, have now had their convictions overturned, according to recent reports.
The Court of Appeal overturned the convictions of Bushnell, aged 17, and Knight, aged 18, who had initially been found guilty of manslaughter in connection to the death of Mikey Roynon. The incident occurred when Shane Cunningham fatally stabbed Mikey with a zombie knife at a residence in Bath, Somerset, in June 2023.
Despite efforts by emergency responders, Mikey succumbed to a single stab wound. During the trial, it was suggested that Mikey might have been carrying a knife, but it was later revealed that he did not have one on him at the time of the incident, with no supporting evidence found by detectives.
While Cunningham remains incarcerated after being convicted of Mikey’s murder in a trial at Bristol Crown Court, Bushnell and Knight were convicted of manslaughter through joint enterprise, a legal principle applied when it is believed that one person has aided another in committing a crime.
Having served over two years in prison, Bushnell and Knight successfully appealed their sentences. A retrial was scheduled, but during a hearing at Bristol Crown Court, Christopher Quinlan KC stated that there was no longer a viable chance of upholding the manslaughter convictions.
In a statement, a spokesperson from the Crown Prosecution Service explained that due to changes in available evidence and careful assessment, the possibility of conviction was no longer feasible. Three judges confirmed that the prosecution had withdrawn its evidence in both cases, leading to the lifting of reporting restrictions.
Baroness Carr, in the judgment, highlighted a crucial error in the jury instructions that rendered the convictions unsafe. Cunningham, in his defense, claimed he acted in self-defense when he stabbed Mikey, alleging that Mikey had threatened his friends with a knife in the garden.
During the sentencing hearing, Mr. Justice Saini permitted the identification of Cunningham, Bushnell, and Knight despite their ages, following a request from the PA news agency. The judge expressed sorrow for the promising future Mikey had ahead and emphasized the devastating loss suffered by his family. He also highlighted the prevalence of knife-related crimes in Bristol and its environs.
